As part of the Queensland Governments review of the rental property sector they have legislated a number of reforms.  A number were implemented last year.  This year, the changes include only increasing the rent once per year which comes into effect as of the 1st July 2023 and the introduction of the Minimum Housing Standards which comes into effect on the 1st September 2023 for all new tenancies.

The Minimum Housing Standards have been designed to ensure rental properties in Queensland are safe, secure and functional.  They have been designed to provide clarity to all tenants, residents, property managers and owners around maintenance obligations for rental properties.

In accordance with Section 185 of the Residential Tenancies and Rooming Accommodation Act 2008 (RTRA Act), the lessor/landlord must, at the commencement of the tenancy and while the tenancy continues, ensure that the premises and inclusions comply with any prescribed minimum housing standards. The areas covered include:-

  • Safety and Security in the areas of:-
    • weatherproofing and structurally sound
    • fixtures and fittings
    • locks on windows and doors
    • vermin, damp and mould
    • privacy
  • Reasonable functionality in the areas of:-
    • plumbing and drainage
    • bathrooms and toilets
    • kitchen
    • laundry

To reflect the above changes, the definition of “Emergency Repairs” in Section 214 of the RTRA Act has also recently been amended to include works that are needed for the premises or inclusions to comply with the prescribed minimum housing standards.

As we embrace our perfect Queensland winter, if you are considering moving, we strongly recommend you get ahead of the pack and hit the market now.  Don’t wait for Spring.  Yes, the gardenias are out but there is greater competition with a larger number of properties on the market in Spring.  Buyers will have choice and hence “shop” your home against the next.  The lack of supply is holding our property prices.  Again, in May we experienced a slight increase in the median house price in Brisbane. Some of our highest value sales have been in the winter months.
